ไทย-เขมรสู้ศึกบนศาลโลก สางคดีพระวิหารครึ่งศตวรรษ

วัน ที่ 30 พ.ค.นี้ ไทยและกัมพูชาต้องต่อสู้กันอีกครั้งแต่ไม่ใช่การใช้อาวุธ เป็นการต่อสู้บนเวทีศาลยุติธรรมระหว่างประ เทศ หรือที่เรียกกันว่า ศาลโลก ที่กรุงเฮก ประเทศเนเธอร์แลนด์

ศึกครั้งนี้ใหญ่หลวงเพราะเป็นการ ตีความคำพิพากษาที่ตัดสินไปเกือบ 50 ปีก่อน หรือเมื่อปีพ.ศ.2505 ซึ่งผลของการตัดสินครั้งนั้นทำให้ปราสาทพระวิหารเป็นของกัมพูชา แต่ในส่วนของเส้นเขตแดน ศาลโลกไม่เคยแตะต้องแต่อย่างใด

ทำให้ พื้นที่ใกล้เคียงปราสาทพระวิหารซึ่งยังไม่มีความชัดเจนในเรื่องเขตแดนยังคง เป็นปัญหาคาราคาซังระหว่างไทยและกัมพูชากันมานานนับชั่วอายุคน

การ ปะทะกันตามแนวชายแดนไทย-กัมพูชาเกิดขึ้นบ่อยครั้ง หลังจากปราสาทพระวิหารได้ขึ้นทะเบียนเป็นมรดกโลก หากเปรียบเทียบกำลังอาวุธยุทโธปกรณ์ ไทยเป็นต่ออย่างเห็นได้ชัด กัมพูชาจึงพยายามดึงเรื่องพิพาท กับไทยให้เข้าสู่เวทีระดับโลกให้ได้เพราะคิดว่ายังมีไพ่ในมือเล่นอยู่


กัมพูชา เดินตามเกมที่วางไว้โดยยื่นคำขอให้ศาลโลกเมื่อวันที่ 28 เม.ย.ที่ผ่านมา เพื่อขอให้ตีความคำพิพากษาในคดีปราสาทพระวิหารในปี 2505 ในประเด็น "พื้นที่รอบปราสาทพระวิหาร" เพราะทำให้กัมพูชาเดินหน้าแผนบริหารจัดการปราสาทพระวิหารไม่ได้

ขณะ เดียวกัน กัมพูชาขอให้ศาลโลกออกมาตรการชั่วคราว 3 ข้อ คือ ขอให้ไทยถอนกำลังทั้งหมดออกจากปราสาทพระวิหาร ห้ามไทยมีกิจกรรมทางทหารใดๆ ในพื้นที่ปราสาทพระวิหาร และให้ไทยงดการกระทำหรือดำเนินกิจการใดๆ ที่กระทบกับสิทธิของกัมพูชาหรือเพิ่มความขัดแย้งในการตีความจนกว่าศาลโลกจะ ตี ความแล้วเสร็จ

แม้ไทยไม่ให้การยอมรับอำนาจศาลโลกหลังคดีปราสาทพระ วิหาร แต่ไทยจะไปขึ้นศาลโลกอีกครั้ง เพราะการยื่นคำขอต่อศาลโลกครั้งนี้ไม่ใช่เป็นการฟ้องคดีใหม่ แต่เป็นการตีความคดีที่ศาลตัดสินไปแล้วและคำพิพากษา มีผลผูกพันกับไทย



ใน วันดังกล่าว ศาลจะตีความ ในประเด็นที่เกี่ยว กับมาตรการชั่วคราวที่กัมพูชาร้องขอมาเท่านั้น โดยศาลกำหนดรูปแบบการให้การโดยวาจา (oral hearing) ในวันที่ 30-31 พ.ค. ซึ่งให้เวลาฝ่ายกัมพูชาให้การในช่วงเช้าและฝ่ายไทยในช่วงบ่ายของแต่ละวัน โดยรวมแล้วแต่ละฝ่ายจะมีเวลาให้การ 5 ชั่วโมง จากนั้นอีกประมาณ 3 สัปดาห์ จึงจะทราบผลการพิจารณาของศาล

คณะดำเนินคดีปราสาทพระวิหารของไทย ประกอบด้วย เอก อัครราชทูตไทย ประจำเนเธอร์แลนด์เป็นตัวแทน (Agent) อธิบดีกรมสนธิสัญญาและกฎ หมายเป็นรองตัว แทนที่ปรึกษาอื่นๆ เช่น รมว.ต่างประ เทศ รมว.กลาโหม รวมทั้งที่ปรึกษาชาวฝรั่งเศส ออสเตรเลียและแคนาดา ซึ่งเป็นผู้เชี่ยวชาญด้านกฎหมายระหว่างประเทศเพราะศาลโลกใช้สองภาษา คือ ภาษาอังกฤษและฝรั่งเศส ประกอบกับคำร้องขอให้ตีความของกัมพูชาใช้ภาษาฝรั่งเศส

นอกจากนี้ ไทยและกัมพูชายังแต่งตั้ง ผู้พิพากษาเฉพาะกิจได้อีกฝ่ายละ 1 คน ซึ่งไทยทาบทามผู้พิพากษาชาวฝรั่งเศสเป็นผู้พิพากษาเฉพาะกิจของฝ่ายไทย เพราะเป็นนักกฎหมายที่ได้รับการยอมรับและมีแนวคิดไม่เห็นด้วยกับคำพิพากษาใน คดีปราสาทพระวิหารซึ่งสอด คล้องกับแนวคิดคณะที่ปรึกษากฎหมายของฝ่ายไทย อีกทั้งยังเข้าใจแนวคิดทางกฎหมายของฝรั่งเศสและเคยเป็นผู้พิพากษาเฉพาะกิจมา หลายคดีแล้ว

แม้ผู้พิพากษาเฉพาะกิจไม่ใช่ผู้แทนของประเทศที่ ได้เลือก โดยจะปฏิบัติหน้าที่อย่างอิสระโดยได้รับเงินค่าจ้างจากศาลโลก แต่ในทางปฏิบัติ ผู้พิพากษาเฉพาะกิจจะทำหน้าที่เป็นหลักประกันว่าผู้พิพากษาอื่นๆ 15 คน เข้าใจท่าทีของฝ่ายไทย

ส่วนผลเบื้องต้นจะออกมาเป็นอย่างไร คาดว่าจะใช้เวลาอีกราวสามสัปดาห์จากนั้น

Russian Nudist Beach In a catalogue “1000 Best Beaches of the World” recently published in the USA Russia is represented only by the beach of the “Naturist Society” in the Gulf of Finland under St. Petersburg. The beach administration has demonstrated the colourful illustrated catalogue and marks that no other Russian beach was included in the rating. “Our beach is traditional and the citizens got used to it. Even those who come to the neighbouring sanatoriums and vacation hotels express interest and call us to know whether the beach is working”, as the beach administration says. According to the “Naturist Society”, their nudist beach is the only recognized one in St. Petersburg. From the lovely Baltic Sea, to the Russian nudists capital of St. Petersburg, naturism in Russia has grown by leaps and bounds since the dissolution of the communist block and the disbandment of the former communist led Soviet Union. Russian nudists have formed their own union, groups, and communes all across the large historic Eurasian nation. Russian nudist and naturists enjoy the wide open plains and beautiful terrain that makes up a vast portion of the large country. Much like its former enemy and current ally, the United States, Russia is a vast and varied country, though it has a much deeper lineage and a much larger more sanctified heritage. It is a storied nation whose history dates back past the birth of the Christ. Most Russian nudists in fact believe strongly in the Messiah and long to experience nature at its barest. Russian nudists are a very healthy bunch for the most part. Very physically fit and trim. Just look at Russian athletes in this day and age such as Sergei Federov, Maria Sharapova, and Pavel Bure, they are all healthy and vibrant, and tend to age slower than other peoples. The Russian people as a whole are a very healthy people, largely due to the work ethic required to exist in Russia, Russia is a largely blue collar nation filled with physical people that live off of the rugged land harvesting their needs with blood, sweat, and tears. Russian nudists fit this mold even more so as they believe spiritually in harmony with nature. Not only do they strive to live off of the land, they strive to be one with their natural surroundings without upsetting the balance of man, god, and country. Russia is a tough, rugged country with large portions of unsettled territory and brutally harsh winters. That being said, there are numerous spas and resorts all over the country that were built by and specifically for Russian nudists. They are visited by tens of thousands of nudists every year, and in some cases the spas are high traffic tourist destinations due the beauty of the resorts. Russian nudists often live naturally as whole families with naturist churches, gatherings, activities, and communes. Russian nudists work closely with the Christian and catholic churches that are the central religion of the old country. There are nudist and naturist organizations all over the country from border to border, and in all the major cities including even Moscow. There are even Russian nudist organizations in the heart of the most god awful inhabited land, perhaps, on the face of this planet. Russian naturists even exist in what was once a winter prison known as Siberia. There are brave and crazy Russian nudists that weather the sub zero temperatures of large bodies of water in Russia in the heart of the coldest of winters. Hypothermia or not, they believe so strongly in naturism that they risk their bodies in freezing waters and icy conditions, like naked polar bears, to experience nature at its most brutal. If that isn’t a true exhibition of a desire to experience nature, then I certainly don’t know what is. Nude In Russia's main focus is outdoor nudity and flashing joining the natural beauties of Russian landscape as well as the most famous monuments with the beauty of the nude female body. Public nudity is one topic, but so is outdoor nudity, or even more so nude in the snow, showing how chilly on one hand side, but also how beautiful and romantic the snowy Russian winters can get. The fun and natural enthusiasm shown by our girls in all series, even during the coldest temperatures (-26.5°C / -16°F so far was the coldest we did a series at) is something we are very proud to share and also led us to open another new additional section (meaning we did not cut down on any other updates for this) which is studio and in-private series where some girls like to show us a more glamorous side and some others a nastier side of themselves. We show Russian daily life as well as locations off the beaten tourist track and we also provide background information on significant sights and monuments we had our girls pose in front of. Shivering, but still having fun and enjoying themselves, we have our girls play with and in the snow and at times there are many people around enjoying whatever our girls are willing to play along live. We also provide bio information on each girl as well as a description of what happened at each specific series, so you can understand better what happened and empathize the live experience.
