You're not very clear about your message, you didn't said the plan was taking off or landing. you were saying another passenger is using the phone while the plan was flying, yes he/she could, while the plan is flying in the altitude that were set... I don't see any problem because the Captain allowed.
you seem very misunderstood FAA's rules or maybe you have a problem with that passenger right next to you.
